Terms of Contributions
iCareBetter Inc. (“we,” “us,” or “our”) would like to provide an opportunity for NancysNookEndo.com’s supporters (“you,” “your”) to make a voluntary financial contribution (“Contribution”) and thereby support our commitment to providing NancysNookEndo.com with financial and editorial independence into perpetuity.
These Terms and Conditions govern the relationship between us and you, including the terms on which Contributions may be accepted, refused, or returned by us. Contributions will only be accepted in the form of a one-off or monthly recurring payment made directly to us as described in these Terms and Conditions.
1. AGREEMENT
By making a financial contribution, you agree and acknowledge that:
Contribution is provided to us as an irrevocable gift, subject to any exercise of your right to receive a refund as described below and our right to return any Contributions at our discretion.
Contribution is made subject to these Terms and Conditions, which shall constitute a legally binding agreement between you and us (the “Agreement”), entered into by each party in consideration of the other’s obligations under these Terms and Conditions.
2. RECURRING CONTRIBUTION PAYMENTS
You agree to pay your selected Contribution amount on a rolling monthly basis.
Recurring Contribution amounts can be changed by contacting us by email at info@icarebetter.com.
You must provide us with complete and accurate payment information at the time you agree to pay a recurring monthly Contribution.
Your payments will be taken on a rolling basis and your recurring Contribution will continue unless and until it is ended by you or us in accordance with the provisions of section 5 (Refunds and Cancellation of Contributions).
3. CONDITIONS
Contributions will be accepted from individuals as well as any other legal entities (such as companies).
Donors who are individuals must be aged 18 or more.
4. ADMINISTRATION OF CONTRIBUTIONS
All Contributions to us shall be made through the support page on www.nancysnookendo.com/support. Contributions will be accepted by us for the period during which the support page is live.
Contributions to us will be received by our payment processor and will be held by the processor until they are paid out to our bank account.
Each Contribution will be identifiable by name, email address, and a unique identification number and so are individually refundable, and will be accounted for separately by us.
From the moment Contribution is processed, we will be legally and beneficially entitled to the full amount of Contribution and you have no entitlement to the return of Contribution in any circumstances other than as specified in these Terms and Conditions.
You shall receive no benefit in return for any Contribution and shall have no rights to influence the business decisions, editorial policy, or output of our works.
We are a for-profit business and Contributions will be used to support our operations and not dedicated for any charitable purpose. Contributions to us are not charitable donations under the laws of the United States and, as far as we are aware, you shall not be entitled to any charitable contribution deduction in respect of your Contribution under either United States Federal or State law or the laws of any other jurisdiction worldwide.
5. REFUNDS AND CANCELLATION OF CONTRIBUTIONS
We reserve the right to refuse and return any Contribution in our absolute discretion, including without limitation where we believe that accepting Contribution would conflict with the mission, values or interests of us, and/or where, having regard to the source of Contribution or intentions of the donor, we consider that to accept Contribution could damage the independence or reputation of us or adversely affect the relationship of us with other contributors or stakeholders.
You shall be entitled to receive a refund of your Contribution for up to 14 days after receipt of payment by notifying us by email at info@icarebetter.com. Any requests for a refund of Contribution received by us following the expiry of the 14 day period will be ineligible.
Any refused and/or returned Contributions shall be repaid into the account from which Contribution was made.
Recurring Contributions can be cancelled at any time, simply email info@icarebetter.com. Cancellation requests will be confirmed within 48 hours.
6. TRANSPARENCY OF CONTRIBUTIONS
We reserve the right to:
Request the full name and contact details of the contributor;
Request from the contributor any other information that we consider to be necessary or desirable to determine the provenance of Contribution;
Undertake any further investigations it deems fit to determine the provenance of Contribution.
If you refuse to provide any information requested by us under clause 5.1, we may refuse and return the financial contribution to you at our discretion.
7. CONFIDENTIALITY AND PUBLICITY
You shall not be entitled to publicise your Contribution or otherwise market yourself or any connected person or business in connection with your Contribution, except with the prior written consent of us and then only if you comply with any relevant requirements of us. The aforementioned restrictions shall not apply to any options for publicising Contributions that we may make available to contributors from time to time e.g. social sharing buttons on support pages.
8. DATA PROTECTION AND PRIVACY
Any personal information about a contributor obtained by us as a result of Contribution being made will be used in accordance with the our privacy policy, available at https://nancysnookendo.com/privacy-policy/. By making Contribution, you accept the terms and conditions of the privacy policy.
9. EXCLUSION OF LIABILITY
Neither we nor any affiliated person, employee, agent, officer or director shall be liable for any loss suffered by you or other person arising out of or in connection with Contribution, whether direct or indirect, including loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, except in respect of any liability for death or personal injury or any other liability which cannot be excluded or limited under applicable law.
10. MISCELLANEOUS
A failure of iCareBetter to assert a right or provision under these Terms and Conditions shall not constitute a waiver of that right or provision.
If any provision of these Terms and Conditions is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, that provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms and Conditions will continue in full force and effect.
This Agreement constitutes the entire agreement between you and us in respect of any Contributions made by you on www.nancysnookendo.com/support.
The Agreement and any non-contractual obligations arising out of or in connection with it will be governed by Massachusetts law and subject to the exclusive jurisdiction of the courts of Massachusetts.
We reserve the right, at our sole discretion, to change or modify portions of these Terms and Conditions at any time. When we do this, we will post the revised Terms and Conditions on this page and will indicate the date of such revision.
Your continued Contributions and/or use of the services after the date of any such changes constitutes your acceptance of the new Terms and Conditions. To the extent allowed by law, the English version of these Terms and Conditions is binding and other translations are for convenience only. If you do not wish to accept the new Terms and Conditions, you may discontinue your Contributions.

12. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms and Conditions are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts applicable to agreements made and performed within the Commonwealth of Massachusetts, without resort to its conflict of law principles.
